1.    INTRODUCTION

1.1      Welcome to “discovergreece.com”, a website owned and administered by the company with the company name «MARKETING GREECE ΑΝΩΝΥΜΗ ΕΤΑΙΡΕΙΑ ΠΡΟΩΘΗΣΗΣ ΚΑΙ ΑΝΑΠΤΥΞΗΣ ΤΟΥ ΤΟΥΡΙΣΜΟΥ» and distinctive title «MARKETING GREECE S.A.», having its registered seat in Pythia (Voukourestiou Str. 20, Athens, Greece, Postal Code 10671) with registration number/ EUID ELGEMI.125083101000 and VAT number 800486464, as legally represented (hereinafter referred to as "MARKETING GREECE", or "Our Company").

1.2.       Through the Website we provide you with our Digital Assistant (Chatbot) "Pythia" (hereinafter referred to as "Digital Assistant" or "Pythia"), which operates using artificial intelligence technologies. The Digital Assistant is also available through the communication application "What's app" at the following details: https://wa.me/+12369003523, or through our pages in the social networking applications "Messenger", "Instagram".

1.3.       The Digital Assistant is provided to our Company as a service by the provider company "Matador Ventures, Inc.” (hereinafter referred to as "Digital Assistant Provider»). More detailed information about the Digital Assistant Provider can be found on its website here: https://matadornetwork.com/ . 

1.4.       Any use of the Digital Assistant is subject to these Digital Assistant Terms of Use and the Digital Assistant Privacy Policy, available here. Since the Digital Assistant is provided as a tool and service of our Website, its use is also subject to the General Terms of Use of the Website. For information on how we process your personal data when you use our Website and other services, please refer to the Website's Privacy Policy.

1.5.       By using the Digital Assistant you declare that you have read, examined, understood and accepted all the terms included in these Digital Assistant Terms of Use and the Digital Assistant Privacy Policy, as well as the General Terms of Use and Privacy Policy of our Website (hereinafter collectively "Terms of Use"). These Terms of Use will govern the use of the Digital Assistant in any way and by any means (e.g. use through the social media pages of Marketing Greece in Messenger or Instagram platform). If you do not agree with any of the Terms of Use, you should refrain from visiting and using the Digital Assistant.

1.6.       The Terms of Use and the services Marketing Greece provides through the Website and the Digital Assistant may be amended from time to time and at any frequency without specific notice. The Terms of Use are binding and effective immediately from the time they are published on our Website. We advise you to check and carefully read the Terms of Use each time before using the Digital Assistant, as its use by you implies and indicates that you accept them.

2.     PROMOTION OF GREEK TRAVEL PRODUCT

2.1        The purpose of Μarketing Greece, through its Digital Assistant, Website, activity and services, is the promotion and development of the Greek tourism and travel-related products and services, in accordance with international market trends, for the benefit of travelers and product and service suppliers to the travel market.

2.2.       The Website operates as an online platform providing travelers with useful information before, during and after the trip, on hotels, travel agents, transport enterprises, tour guides, restaurants, bars and cafes, museums and sites of archaeological interest, Greek designers, as well as Greek providers of other travel-related products and services, «Discovergreece.com» aspires to become an online platform through which travelers will discover the best Greece has to offer. 

2.3.       Digital Assistant powered by artificial intelligence technologies provides you, in an automated way, with useful information about the Greek travel product from our Website, facilitating your access to its information material.

3.     SCOPE

3.1.       The Terms of Use refer to and apply to all services and functions provided by Marketing Greece through the Digital Assistant.

3.2.       By accessing the Digital Assistant, you, the user, unconditionally declare and confirm that you agree with the content of the Terms of Use and understand it. If you do not agree with part and/or all of the Terms of Use, you should not use the Digital Assistant and the services provided through it.

3.3.       Μarketing Greece reserves the right to prohibit the use of the Digital Assistant and the services provided through the Digital Assistant, in case the user does not comply with the Terms of Use and the applicable legislation.

4.    SERVICE DESCRIPTION

4.1.       Μarketing Greece does not itself provide ordering or booking services or purchase or payment of transport tickets (air, ferry, railway, urban-intercity) and/or entertainment (tickets for performances, entrance to museums and guided tours) and/or rooms for accommodation in hotels and lodgings, and generally does not provide any service of such kind (e.g. travel) and does not sell any travel product to you. Through the Website and the Digital Assistant, Marketing Greece provides promotional services and information in relation to the Greek travel product. The content/information and such services are provided to you "as is", without any warranty expressed or implied by Marketing Greece in any way. 

4.2.       When you make any order/reservation/purchase/payment of tickets (such as air, ferry, rail, urban-transit), rooms for accommodation in hotels and lodgings, tickets for shows, admissions to museums and guided tours, purchase of products and in general in any transaction through the Website and the Digital Assistant, you enter into a contract directly with the third party company that provides you with the respective products/services (hereinafter "Service Provider"). Any contractual relationship for travel products and services is concluded exclusively between you and the Service Provider of your choice. The relevant contractual responsibilities and obligations are borne exclusively by you and the Service Provider and any charges are made exclusively by the Service Provider.

4.3.       Service Providers who promote services through the Website and the Digital Assistant have a contractual relationship with Marketing Greece and Marketing Greece receives subscription fees from them for the promotion and advertising of their services, in order to provide you with free information services for the Greek travel product.

4.4.       All information published on the Website is provided directly by Service Providers. Marketing Greece has no control of this information. Service Providers have the exclusive liability for the correctness, completeness and accuracy of the said information (indicatively: prices, charges and any other payment for the provision of their service to you, availability, cancellation policy and in general the terms and conditions under which they provide their service to you). Marketing Greece, in any case, does not guarantee and/or does not confirm the correctness, completeness and accuracy of the said information of the Service Providers, nor is liable towards you, the user, for any reason which is associated to the contractual relationship between you and the Service Provider. Marketing Greece does not, directly or indirectly, through the Website and/or the Digital Assistant, accept or approve or recommend or suggest to you of any of the Service Providers or their services/products.

4.5.       Our Company does not intervene or bear any responsibility regarding the information, websites, products and services of third parties, which are displayed through the Digital Assistant during your interaction with it. The Digital Assistant operates as a communication tool/Chatbot of our Company in order to provide information services and to facilitate your access to the information material of our Website regarding the Greek travel product, without our Company assuming any responsibility for the services and/or travel products of third parties.

4.6.       In any case, we recommend that you carefully read and save a copy/print the terms of use of the website of each Service Provider to safeguard your interests and rights.

4.7.        In the event that in any way (e.g. through our Website, through Athens) we provide you with access to other websites, administered, and owned by third parties, including Service Providers, these third parties are fully and exclusively responsible for the content of their websites. Marketing Greece is not entitled to intervene in the content of these websites and does not guarantee or assume any responsibility for their content, nor for the correctness, truthfulness, accuracy of the information provided therein. Marketing Greece does not itself provide hospitality services, accommodation, transportation, catering, guided tours, excursions, rentals, nor does it sell related products, since the provision of these services and the sale of related products (e.g. air or ferry or rail tickets, event tickets, hotel reservations, etc.) are provided and concluded with you (the user) and the Service Provider. Marketing Greece has no liability (contractual or for tort) in case of non-performance, poor performance, and in general any liability for any reason whatsoever associated with the provision of the services or the sale of products of Service Providers, given that the said services are not provided (and the products are not sold) by Marketing Greece. Likewise, Marketing Greece is not responsible/liable for the way you use and interact with the websites of these third party enterprises/companies.

4.8.       We advise you to be very careful when you proceed with transactions for services provided or products sold by Service Providers, because these transactions are governed by terms that might have limitation of liability or disclaimer. These terms may also demand your approval and/or your consent.

5.    DESCRIPTION OF USE OF THE DIGITAL ASSISTANT 

5.1.       The Digital Assistant, utilizing AI technologies, promotes and facilitates communication with the users of the Website and the promotion of the Greek travel product of our Website. It is essentially an AI Chatbot oriented to provide information services about the Greek travel product promoted by Marketing Greece.

5.2.       At any time you have the right to request the human intervention of a representative of Marketing Greece by selecting the relevant icon with the word indication "Right to ask Human Intervention - Contact a Representative" accessible through Pythia or by requesting it in writing from Pythia in a clear way (e.g. by stating in your communication "I wish to contact a representative, natural person"). You may also stop using the Digital Assistant at any time and contact us by post, email, or telephone using our contact details available in our Terms of Use and on our Website.

5.3.       You do not need to disclose your personal data during your communication/conversation with Pythia in order for her to function and respond to your request/query. The information material it provides you is displayed depending on the search criteria that you enter in the Digital Assistant, without you having to share your personal data to receive such information. For example, you can ask the Digital Assistant to inform you about the available "French cuisine restaurants in the center of Athens", without disclosing any personal information (e.g. your name, the details of your tablemates). The Digital Assistant will respond to your question/request and will provide you with the relevant information according to the criteria you have set, without asking you any personal information/data.  In case you are looking for more specific information about travel services and products, you can specify your criteria without again disclosing personal information about yourself or third parties. 5.4.       The use of Pythia is optional and free of charge.  The aforementioned information services are provided, in any way (e.g. through the Website, Digital Assistant) by Marketing Greece to you, the user, completely free of charge. In other words, we do not charge you any fee for the information services we provide to you through the Website and/or Athens regarding the Greek travel product.

5.5.       The information material provided by Pythia is sourced from our Company's Website and includes information on the travel services/products of the Service Providers. Pythia does not interfere with the content of this information and refers you to the Service Providers' websites in order to check their product/service information and transaction terms if you intend to transact with them.

6.     RESTRICTIONS ON THE USE OF DIGITAL ASSISTANT - USER WARRANTIES

6.1        You are prohobited to use the Digital Assistant to harm third parties, including Marketing Greece, in any way (e.g. by submitting defamatory, threatening comments, hate speech, installation of malware), as well as their rights, indicatively their rights to the protection of industrial and intellectual property and confidentiality/personal data.

6.2.       The user is prohibited from destroying, disabling, overloading or damaging the Digital Assistant, using unauthorized means in order to modify its content, or interfering with its operation in any way.

6.3.       The user declares and warrants that he/she will under no circumstances disclose, transmit, process his/her own or third natural persons' personal data (e.g. identification such as full name, contact such as telephone details) and in particular special categories of personal data (e.g. health, sexual preferences, political opinions, religious beliefs) through the Digital Assistant throughout this use.

6.4.       In any case, the user acknowledges and accepts unreservedly that he is solely responsible for any damage or damage suffered by Marketing Greece, as well as any third party, regardless of its specific cause and kind, as a consequence, directly or indirectly, of the violation of any term hereof and / or the applicable legislation by the user.

6.5.       The use of the Digital Assistant and the services of Marketing Greece in general (e.g. its Website) requires that you, the user, have reached the age of 18, have legal capacity and have been duly authorized in case you use it by the third parties for whom you act.

6.6.       The user declares and guarantees that under no circumstances will he propose or accept the conclusion of an agreement, contract, binding terms with the Digital Assistant, nor will he ever invoke the existence of such a contract/agreement, as  the user acknowledges and fully understands that through the Digital Assistant no negotiations are initiated or terminated and no agreements/contracts are concluded with a legal commitment of Marketing Greece,  as well as that the Digital Assistant can in no way represent or legally bind Marketing Greece, which can only be represented through the relevant competent persons.

6.7.       The user acknowledges that Marketing Greece does not provide travel services / products through the Digital Assistant, and that Marketing Greece does not act in any way as an agent, representative, representative of the Service Providers, who are solely responsible for the products and services they may provide to the user, as well as for the completeness, correctness and accuracy of the information of their products and services. The user declares and guarantees that he will address exclusively to the Service Providers for the products / services he chooses during any transaction with them.

6.8.       The user understands that by using the Digital Assistant the user interacts with an artificial intelligence Chatbot that provides information about travel services/products of third parties/providers based on their available information. The user declares and guarantees that he/she will not make decisions solely on the basis of the information material provided by the Digital Assistant, nor will he/she consider in advance the information material of the presented travel services/products of third parties/providers as completely up-to-date and accurate, but will always cross-check/verify  the information material by any appropriate and necessary means,  including, at least, direct communication with the Service Providers (e.g. by checking the information on Service Providers' websites, contacting Service Providers directly and their customer service).

7.     INTELLECTUAL PROPERTY RIGHTS

7.1.       Unless stated otherwise, the content of the Website and the Digital Assistant, including intellectual property rights (industrial property rights and copyright), intangible assets, non-registered, pictures, graphic designs, designs, texts, structure, «look & feel», are Marketing Greece’s and/or third parties’ exclusive property and are protected by Greek law, EU law and international treaties and agreements.

7.2.       Consequently, you accept and understand that you do not have the right to use, copy, extract, re-utilise, sell, resell, distribute, download, upload and/or commercially exploit, present to the public in any way any content or parts of the content of the Website and the Digital Assistant for any reason, unless you have prior written consent of Marketing Greece, of the third party, of the owner or licensee. It is also prohibited to reproduce and export in any way the content, material, texts and data of the Website and its tools, including the Digital Assistant, for mining purposes (e.g. through any technology, automated means of text and data mining), regardless of whether this Website (Digital Assistant included) prevents such actions by technical means. 

7.3.       You acknowledge and accept that you have no right to reproduce, copy, sell, resell and/or exploit commercially in any way, in whole or in part, the content of the Website and the Digital Assistant, with the explicit reservation of Marketing Greece’s rights regarding the exercise of its claims and rights against the person who infringes this very term in any way.

8.     LIABILITY - INDEMNIFICATION

8.1.       These Terms & Conditions set out the full extent of Marketing Greece's obligations and liabilities in respect of the promotional services offered through the Digital Assistant, unless as agreed otherwise in specific terms of use. The content and services of the Digital Assistant are provided on an “as is” basis, without any guarantee, expressed or implied, by Marketing Greece by any means.

8.2.       With the explicit reservation of its rights, Marketing Greece does not guarantee, assumes no liability (civil or penal) and/or obligation, for any damage that might occur to the user caused by the use of the Digital Assistant and/or the provision of the services by Service Providers (indicatively in case of non-appropriateness, non-availability, non-adequacy, non-safety of the products/services of Service Providers).

8.3.       Marketing Greece, to the maximum extent provided by law, assumes no liability under all circumstances and in any case (negligence included) for any damage that may occur to the user or any third party (both material and non-material, direct or indirect or of any other type and for any cause):

(a)    due to the use of the services and content of the Digital Assistant (e.g. inaccurate information provided by Service Providers), given that the user uses the Digital Assistant οn their own initiative and has full understanding of the Terms of Use and/or,

(b)    due to acts of any user of the Digital Assistant violating the Terms of Use or any other terms of use specifically agreed between Marketing Greece and the user and the applicable legislation,

(c)    due to force majeure and events which are not under the direct control of Marketing Greece, such as: non-availability or errors of the Digital Assistant and the services provided by the Digital Assistant (indicatively and not exclusively: unavailability of Digital Assistant, failure of technological equipment, telecommunication failure) or for other technical reasons or reasons regarding the technical maintenance of the Digital Assistant,

(d)     due to acts, omissions and errors of third-party providers and third parties including Service Providers (indicatively and non-exclusively lack of license or any governmental authorization, lack of safety/non-compliance with, bugs, software viruses, corruption, the manipulation or amendments of the Digital Assistant by third parties without Marketing Greece’s consent),

(e)    due to information and material available in the Website and the Digital Assistant, which is provided and/or licensed by third parties or has been collected by third party sources (including Service Providers), which are not controlled by Marketing Greece,

(f)    due to comments and/or content published on the Website by the user or any third party.

The users are exclusively and solely liable for all the transactions made through or as a consequence of the use of the Website and the Digital Assistant, as well as for the specific terms and conditions of the said transactions.

To the maximum extent permitted by law, Marketing Greece’s liability towards the user or any third party for compensation for any claim (tort included) is excluded.

You agree to indemnify, defend and hold Marketing Greece harmless from any liability, loss, damages, claim and expense related to your violation of these Terms of Use and in case which causes Marketing Greece the abovementioned. 

8.4.       You explicitly agree and accept that the Service Provider assumes the exclusive liability towards you regarding the provision by the Service Provider to you of services through the Website, given that Marketing Greece is not a seller or a reseller of any Service Provider’s service or product. For any complaint or claim you might have against the Service Provider, you shall address directly the Service Provider, with whom you have a contractual relationship regarding its products and/or services.

9.     HYPERLINKS

9.1.       The Website and the Digital Assistant contain references through links, hyperlinks to websites of Service Providers, whose availability, content, privacy policy, quality and completeness of their services Marketing Greece does not control. Marketing Greece assumes no liability in any case whatsoever for the availability, the content, the privacy and cookie policy, and the quality or the correctness of the webpages and functions of third party’s websites, which are available to the user through hyperlinks, links or banners. Therefore, in case any problem occurs during the visit or use of such pages/functions, the user shall immediately communicate with the said websites. 

9.2.       Under no circumstances can it be considered that Marketing Greece endorses or approves the content or functions of the websites and webpages to which visitors/users refer or to which this Website and/or the Digital Assistant is linked and/or refers in any way.

9.3.        The user explicitly and undeniably accepts that Marketing Greece has no liability (irrespective of the specific cause or its type) for any loss or damage they might have suffered as a result of non-availability of the aforementioned websites or sources, or as a result of any confidence shown by the user to the completeness, accuracy or existence of any advertisement of any product marketed through the aforementioned websites.

9.4.        We strongly recommend that you carefully read the terms of use and privacy and cookie policy of the aforementioned websites and keep a copy of them.

10.     COMMENTS BY USERS

10.1.    The content of comments you post on the Website and the Digital Assistant must be accurate and lawful in accordance with the Terms of Use and applicable law and must not infringe the rights of Marketing Greece or third parties.

10.2.     Marketing Greece does not assume any responsibility for any illegal comment you may make, while it reserves the right to remove it and suspend and/or prohibit the use of the Digital Assistant, if you violate applicable law and the Terms of Use.

11.     APPLICABLE LAW, JURISDICTION & OTHER TERMS

11.1.    The Terms of Use, any modification thereof, as well as all matters relating to the Website and the services provided by Marketing Greece (and through the Digital Assistant) are governed and regulated by Greek Law.

11.2.    Any dispute arising from these Terms of Use and the Website will be submitted to the Courts of the City of Athens, which have exclusive competency over any other venue. The exclusive jurisdiction of Athens Courts includes interim measures, temporary restraint orders and disputes arising from tort.

11.3.    If any of these provisions cannot be applied for whatever reason or is against the law, this shall not affect the validity of the remaining provisions of the Τerms of Use.

11.4.    Τhe Terms of Use are provided in Greek and English. In case of discrepancies, the Greek version shall prevail.

11.5.    Marketing Greece’s delay to enforce any of its rights or to exercise any right, shall not be considered as a right waiver in any case.
