Terms of Use of the “Talk to a Travel Specialist” Feature

Introduction - Preamble

The use of the “Talk to a Travel Specialist” feature (the “Feature”) is subject to these Terms of Use of said Feature of the website www.discovergreece.com (hereinafter the “Website”), which is owned by the company under the name “MARKETING GREECE ANONIMI ETAIRIA PROOTHISIS KAI ANAPTIKSIS TOY TOYRISMOY” and the distinctive title “MARKETING GREECE A.E.” (Marketing Greece S.A.), having its registered office in Athens (20 Voukourestiou St., 106 71), with G.E.MI. number 125083101000 and Tax Identification Number (AFM) 800486464 (hereinafter “Marketing Greece” or “we” or the “Company”). These Terms concern the aforementioned Feature of the Website and apply in parallel and cumulatively with the General Terms of Use of the Website, the Privacy Policy of the “Talk to a Travel Specialist” Feature, and the Privacy Policy of the Website, which collectively constitute the terms of use (collectively the “Terms of Use”) to which the use of this specific Website Feature is subject.

Our Company reserves the right to modify the Terms of Use from time to time. The Terms of Use, as in force at any given time, shall constitute the terms and conditions upon which we make the Website and the Feature available to you, the user, and shall govern navigation, use, and your legal relationship with Marketing Greece and the Feature it provides via the Website. Before using the Feature, we recommend that you carefully read the Terms of Use, which constitute a legally binding agreement (contract) between Marketing Greece and you.

By accessing and using the Feature, you, the user of the Website, unconditionally declare and warrant that you agree with the content of the Terms of Use and that you understand them. In the event that you do not agree with part or all of the Terms of Use, you must cease navigation on the Website and must not use the services provided through it, including the Feature.

Marketing Greece is entitled to prohibit the use of the Website and the services provided through it, including the Feature, in the event that the user fails to comply with the Terms of Use of the Website and applicable law.

Definitions

For the purposes of these terms, the following definitions have the following meanings:

“Request”: The expression of interest submitted by the User via the “Talk to a Travel Specialist” Feature to communicate with a Partner Travel Provider (Travel Specialist).

“Transmission” (Lead): The transmission in any way (e.g., via email or any other means chosen by the Company) of the User’s Request by the Company to the Provider.

“Reasonable Response Time”: Communication from the Provider to the User immediately following the Transmission, usually within 48 hours from the Transmission.

“Website”: The Company’s website/electronic platform at the address www.discovergreece.com, including the relevant subpages, content management tools, and the “Talk to a Travel Specialist” feature.

“Lead ID”: The unique reference code assigned by the Company to each Transmission (Lead) upon submission of the Request and which accompanies the Transmission.

“Talk to a Travel Specialist Feature” / “Feature”: The digital contact form feature of the Website through which the User submits the Request.

“Products”: The Provider’s tourist and related travel products/services (e.g., tours, activities, outdoor experiences, events, trip planning services), provided by the Provider to the User and/or displayed on the Website.

“Sale”: Any contract/booking/sale of a travel service and/or Product entered into and executed exclusively between the Provider and the User as a result of the Transmission.

“Page”: The Provider’s page/listing on the Website, with content/information/links visible to users.

“Partner Travel Provider (Travel Specialist)” or “Provider”: Any third-party provider, including providers in competition with the Provider, with whom the Company currently cooperates or may cooperate in the future.

“Travel Services”: Services that fall under this definition according to applicable law, which indicatively include accommodation services, passenger transport services, vehicle rental services, related tourist attraction services, and combinations of different types of travel services.

“Services”: The information society services for the Transmission of Requests through the Feature.

“User”: Any natural person who visits the Website and submits a request via the Website. For the Provider, the term User is interpreted to include any of their customers following the conclusion of a Sale after a Transmission.

1. Description of the Feature

1.1. The Services provided by the Company through the Feature concern exclusively the collection of Requests and their Transmission to Partner Travel Providers.

1.2. The Company does not provide, organize, or sell Travel Services and/or Products, nor does it act as a travel agency, organizer, or seller/reseller of Travel Services and/or Products.

1.3. The negotiation, offer, agreement of Travel Services and Products, and their Sale are carried out exclusively between the Partner Travel Provider and the User, and the Company is not a contracting party, nor is it involved in any way, nor does it bear any liability.

1.4. The Feature allows the User to submit a Request, which the Company collects and transmits to any Partner Travel Provider of its choice.

1.5. As a rule, the Company transmits each Request to a Partner Travel Provider of its choice, based on operational and quality criteria (e.g., suitability for the Request, specialization, availability, language of service, destination).

1.6. Provided there is no communication from the Provider to the User within the Reasonable Response Time, or if this is deemed necessary to serve the User, the Company may transmit the same Request (including relevant personal data) to another Provider.

1.7. The Transmission is accompanied by a Lead ID for Transmission management purposes.

1.8. The Company does not guarantee that there will be a response from the Provider (e.g., within the Reasonable Response Time), or that the User will receive an offer, or that a Sale will be concluded between them.

2. User’s Obligations & Warranties

2. The User warrants that they are an adult, over the age of 18, with full legal capacity.

2.1. The User warrants that the data and information entered in the Request are accurate, true, and up-to-date, and that they have the right to enter them into the Feature.

2.2. The User acknowledges that the Request does not constitute an offer to conclude a Sale, nor an offer to purchase (or any type of contract for use of) Travel Services and/or Products to the Company or to the Partner Travel Providers. The submission of an offer can only take place in the context of direct communication between the User and the Partner Travel Provider, if such follows the Transmission.

3. Liability - Disclaimer

3. The Company is not liable for the quality, consistency, suitability, accuracy, legality, offer, provision, or execution of the Travel Services and/or Products offered and/or provided by the Partner Travel Providers to the Users.

3.1. Any dispute or claim related to a Sale and/or Travel Services (e.g., prices, payments, cancellations, changes, complaints, etc.) shall be resolved exclusively between the User and the Partner Travel Provider, who bears the exclusive liability towards the User.

3.2. To the maximum extent permitted by applicable law, the Company bears no liability for any damage (e.g., direct, indirect, incidental, positive, consequential) that may arise against the User due to and/or in connection with the provision of Travel Services and the Sale, as well as the Services and the Feature.

Other Provisions

The Website Terms of Use, as mentioned in the Preamble of these terms, govern the Feature and the Services in a supplementary and cumulative manner, and these terms form an integral and unified part thereof.

The purpose of collecting and processing your personal data is the provision of Services via the Feature, the management of your Request, and its Transmission to Partner Travel Providers.

What is the legal basis for the collection and processing of your personal data?

The processing of your personal data is necessary for the provision of the Services via the Feature and the performance of the contract between us, i.e., the Terms of Use governing the use of the Feature. Therefore, the legal basis for the processing is based on Art. 6(1)(b) of the General Data Protection Regulation (EU 679/2016).

When do we transfer your data to third parties?

The Company transfers the Request data to a Partner Travel Provider (Travel Specialist) so that they may contact you, in accordance with the Terms of Use of the “Talk to a Travel Specialist” Feature.

Each Partner Travel Provider to whom we transfer your Request data following your instruction, in the context of providing our Services via the Feature to you, will process your Request data for their own purposes (e.g., for negotiating Travel Services with you and/or concluding a Sale) and by their own means, acting as an independent data controller regarding your personal data in accordance with applicable law. As an independent data controller, the Provider is obliged to inform you about how they process your personal data in the context of your transactional relationship and to fulfill your legal rights regarding said processing.

Furthermore, in order to provide you with the Services via the Feature, the Company may appoint external/third-party service providers who will act as data processors and provide specific services to the Company, such as internet service providers or technical support service providers. When providing such services, external service providers may process your personal data while acting under the instructions of our Company as data processors in accordance with applicable law. Our Company ensures the protection of your personal data during their processing by such providers through appropriate contractual commitments in accordance with applicable law.

Additionally, the Company may disclose your personal data, in compliance with applicable personal data protection law, to judicial and/or law enforcement authorities, independent authorities, government authorities, or other competent authorities.

Transfers outside the EEA
